			<content:encoded><![CDATA[<h1>One of the major changes in the upcoming iPhone OS 4 is not in the software, but in its license. And that one was aimed at developers.</h1>
<p><a href="http://arstechnica.com/apple/news/2010/04/apple-takes-aim-at-adobe-or-android.ars" target="_self">According to ars technica</a>, section 3.3.1 of Apple&#8217;s (NDA-protected) developer license agreement received a major update. It now states that developers can no longer release applications if these were not coded in Objective C, C or C++. JavaScript is also fine – but has to be executed by the iPhone&#8217;s pre-installed webkit engine. This would be a major blocker for Adobe&#8217;s upcoming release of Flash CS5, which is expected to <a href="http://labs.adobe.com/technologies/flashcs5/appsfor_iphone/" target="_self">publish flash applications straight to the iPhone</a>. Unless Adobe struck a deal with Apple before announcing this hugely anticipated feature months ago, they blindly walked into a disaster.</p>
<p>More importantly though, this marks an end for projects built with popular toolkits like Unity3D or <a href="http://www.mono-project.com/newstouch/archive/2010/Apr-09.html" target="_self">Monotouch</a>, as both use C# for coding. But why would Apple kill some very popular toolkits their developers love and use to build great applications for the iPhone platform? Just to get at Adobe? They would not. Flash is not as important as some may think, and it is not an imminent threat to Apple. Android on the other hand is.</p>
<p>Google&#8217;s platform becomes more attractive to customers, the <a href="http://androidcommunity.com/android-market-sees-growth-spurt-in-march-2010-20100408/" target="_self">Android market is growing rapidly</a> and naturally iPhone developers will notice that, and follow. Cross-platform development toolkits enable them to do most of their work without platform-specific code. Deployment to Android – once it is supported – requires little extra effort. And when popular iPhone applications hit the Android market, they boost its popularity even more. Of course Apple would rather not see customers flirt with the standards-adopting, free software promoting hippie around the corner. Especially because that one is generally less expensive, responds to community requests and, in my humble opinion, is superior by design.</p>
<p>Anyway, these toolkits are not necessarily doomed. Apple may just be getting the word out they do not want developers, or any of these toolkits, to support Android. Read: »You&#8217;re my bitch, <a href="http://gizmodo.com/5464970/apple-takes-the-word-android-out-of-itunes-app-description" target="_blank">don&#8217;t fuck around</a>«. At the same time Apple encourages developers to focus their porting ambitions on  – the iPad.</p>

<p>Update:</p>
<p>Apparently Adobe did not strike a deal with Apple. <a href="http://blogs.adobe.com/conversations/2010/04/cs5_countdown_is_on.html" target="_self">Adobe&#8217;s CTO Kevin Lynch noted</a>:</p>
<blockquote><p><span style="font-size: 13.1944px;">»We intend to still deliver this capability [publishing to iPhone] in CS5 and it is up to Apple whether they choose to allow or disallow applications as their rules shift over time.«</span></p></blockquote>
<p>Still, they must have seen it coming. My guess is Adobe went out of options when Apple shut the door on flash player for iPhone. So this is it: Let&#8217;s throw some thousand applications at iTunes, and see what happens.</p>

<p>2nd update:</p>
<p>It seems <a href="http://mashable.com/2010/04/10/steve-jobs-adobe/" target="_blank">Steve Jobs replied to a mail</a> and pointed to <a href="http://daringfireball.net/2010/04/why_apple_changed_section_331" target="_blank">this blog post</a>. According to that article, Apple pulled the plug on intermediary development tools to maintain platform control. That sounds about right. But Apple has been over-protecting the iPhone from its launch, why would they have allowed those toolkits in the first place?</p>

<p>Registrations were supposed to be turned off on this installation, but they were not. Anyway, there is no entry point for registering a new user on my wordpress theme. So he must have triggered that request manually.</p>
<p>@Dillinger: Back off.  Although I smiled at <a href="http://en.wikipedia.org/wiki/John_Dillinger" target="_self">how you disguise yourself</a> and generally admire hacking, just leave. Go, play somewhere else.</p>

			<content:encoded><![CDATA[<h1>Der AK Zensur hat heute ein <a href="http://ak-zensur.de/2010/03/ministerrat-stoppschild.html" target="_blank">Dokument des EU-Ministerrats veröffentlicht</a> in dem auch Netzsperren Erwähnung finden.</h1>
<p>Darin wird explizit <a href="http://www.europol.europa.eu/index.asp?page=InternetRelatedChildAbusiveMaterialProject" target="_blank">CIRCAMP (COSPOL Internet Related Child Abusive Material Project)</a> genannt, wobei es sich um eine bei Europol geführte Blacklist von Adressen handelt, die Internet Access Provider ganz oder teilweise blockieren sollen.</p>
<p>Unter den vielen anderen Punkten messe ich diesem einen eine herausragende Rolle bei, weil das Dokument einfach an keiner anderen Stelle konkret wird. Während CIRCAMP sich auf ein spezifisches Projekt bezieht, und bereits ein Ergebnis der Arbeitsgruppe COSPOL darstellt, bleiben Empfehlungen wie die Zusammenarbeit zwischen Institutionen zu verbessern, redundante Organisationsstrukturen abzubauen oder Prozesse zu optimieren, vergleichsweise gehaltlos. Eigentlich handelt es sich um eine Menge Gesülze, in das zwischendurch »Internet Filtering« eingestreut wurde.</p>
<p>Bedauerlich ist auch das Fehlen jeglichen Ansatzes zur Löschung von Seiten. Dies scheint für den Ministerrat ebenso wenig eine Option darzustellen, wie damals für Frau von der Leyen (CDU). Das Gerücht, dass sich Seiten nicht aus dem Netz entfernen ließen wird hierzulande ja ausgerechnet und fast ausschließlich von Internetfernen Schichten (insbesondere den Unionsparteien) propagiert.</p>
<p>Ich glaube auch nicht daran, dass das deutsche Zugangserschwerungsgesetz mittelfristig nicht angewendet werden wird. Es ist vom Bundespräsidenten unterschrieben worden und in Kraft getreten. Ohne ein Aufhebungsgesetz — an dem die derzeitige Regierung kein ernsthaftes Interesse hat — wird es auch irgendwann eingesetzt werden. Zuvor wird es eine vermeintlich »ergebnisoffene Evaluierung« geben, deren Kriterien die Fürsprecher des Gesetzes aller Voraussicht nach aber unter sich ausmachen.</p>

<p>Es ist schön zu sehen, dass die wachsende Zahl der Skeptiker nicht nur in endlosen Diskussionen auf YouTube in Erscheinung tritt. Vor einiger Zeit hatte <a href="http://www.myspace.com/bryansteeksma" target="_self">Brian Steegsma</a> bereits ein kleines Intro mit dem Titel »Listen To Reason« für den <a href="http://www.nonprophetsradio.com/" target="_self">Non-Prophets-Radio Podcast</a> aus Austin/Texas produziert. Obwohl es sich großer Beliebtheit erfreut, liegt es leider nicht mehr bei YouTube oder sonst irgendwo vor.</p>

<p>Und nach dem Bundesdatenschutzgesetz stehen mir daher einige Rechte zu. Ich darf verlangen, dass über mich gespeicherte persönliche Daten (mit wenigen Ausnahmen) gelöscht, gesperrt oder unter Umständen korrigiert werden. Dazu benötige ich allerdings eine Auskunft darüber, welche Daten von mir gespeichert wurden — und gegebenenfalls auch woher diese stammen.</p>
<p>Auf der <a href="http://www.das-elena-verfahren.de/teilnehmer" target="_blank">Informationsseite zu ELENA für Teilnehmer</a> lese ich aber:</p>
<p>»Im ELENA-Verfahren besteht ab 2010 für den Teilnehmer ein Anspruch auf Auskunft über die zu seiner Person gespeicherten Daten. Eine Auskunft ist vor 2012 aber nicht realisierbar, da der Abruf durch die abrufenden Stellen erst ab 2012 möglich ist.«</p>
<p>Ich habe also einen Anspruch auf eine Auskunft, das scheint unstrittig. Diesen habe ich nicht weil ELENA das gnädigerweise einräumt, sondern weil es Gesetz ist. Die zuständige Behörde schreibt aber ganz offen auf ihre Seite, dass sie mindestens zwei Jahre lang keine Auskunft geben wird.</p>
<p>Das klingt in meine Ohren in etwa so:</p>
<p>»Ihr Fahrzeug befindet sich seit gestern in meiner Obhut. Da es sehr bequem und komfortabel ausgestattet ist — und ich längst noch nicht genug davon habe — ist eine Rückgabe vor 2015 nicht realistisch.«</p>
